Here are four easy and quick steps to check if the name of your new business is available. It certainly isn't a complete
list but it will get you started.

1. Domain name/website: To see if the desired domain name for a website is available and who owns the name
if it is already taken.
  • Your current domain suppier  - all have this capability. We use 1and1.com
  • Networksolution.com
  • Register.com (The “Who is it” button is particularly helpful because it allows you to determine the owner of the domain name if it is taken.)
2. Common law usage: To see if there is a common usage of the name.
  • www.google.com
  • www.yahoo.com
3. Federal Trademark and Patent office: To see if there is a trademark or patent already at the Federal Level.
  • United States Patent and Trademark Office (www.USPTO.org)
4. Your Secretary of State: To see if the name already exists within your current state.

Because we are based in California, we used the California Secretary of State, Corporations Section, which is where entrepreneurs incorporate and make their company legal.

Note that it is important to do at least a preliminary check on the availability of your name in each of these areas. Availability
in one area does not guarantee availability in the others. For instance, if your name appears to be available in the first three
areas it could be taken within your state corporations section and they can use this as the basis for rejecting a corporate application.
